Amendments 2013

Amendment No 1 of 2013

Parts II and XI of the Supreme Court Practice Directions have undergone some amendments. Amendment No. 1 of 2013 of the Practice Directions has taken effect on 1 March 2013.

  1. Para 13A on “Attendance at hearings in Chambers” to state for the avoidance of doubt that while chambers hearings in civil proceedings are private in nature, subject to any written law, the Court may, in its discretion, permit interested parties to attend hearings in chambers.
  2. Para 27(1A) on “Requests and other Correspondence” to remind solicitors about the appropriate practice with regard to correspondence between parties and/or the Court.
  3. Para 86A on “Appeals Information Sheet for civil appeals to the Court of Appeal” and Appendix A, to institute a new practice under which each party to a civil appeal will have to file an information sheet related to the appeal, and may also be required to attend before the Court to take directions on the conduct of the appeal.
  4. Para 87(4A) on “Filing of records of appeal, core bundles and written Cases for civil appeals under Order 57, Rules 9 and 9A of the Rules of Court” and Para 87A on “Request for leave to exceed page limit for Appellant’s Case and Respondent’s Case for civil appeals to the Court of Appeal”, to institute new requirements relating to page limits and document formatting vis-à-vis the Appellant’s and Respondent’s Cases in civil matters before the Court of Appeal.
  5. Para 90(6) on “Skeletal arguments for civil matters before the Court of Appeal”, to reflect a change in timelines for the filing of skeletal arguments for civil matters before the Court of Appeal.

Amendment No 2 of 2013

Amendment No. 2 of 2013 of the Practice Directions contain amendments to Parts IV and XI, Appendix A and Appendix B of the Supreme Court Practice Directions and they are set out below

  1. Paragraph 41 on “Ex parte applications for injunctions”; 
  2. The introduction of a new Paragraph 42A on “Documents in support of ex parte applications for injunctions (including Mareva injunctions) and search orders”;
  3. The introduction of a new Paragraph 85A on “Leave of the Court of Appeal to receive further affidavits in relation to an application to strike out a notice of appeal";
  4. Paragraph 87 on “Filing of records of appeal, core bundles and written Cases for civil appeals under Order 57, Rules 9 and 9A of the Rules of Court”;
  5. Paragraph 87A on “Request for leave to exceed page limit for Appellant’s Case, Respondent’s Case and Appellant’s Reply for civil appeals to the Court of Appeal”;
  6. Paragraph 88 on “Hard copies and soft copies for hearing of civil appeals before the Court of Appeal under Order 57 of the Rules of Court”;
  7. Appendix A for Form 12 (Form of Record of Appeal), Form 13 (Form of Core Bundle) and Form 14 (Form of Supplemental Core Bundle); and
  8. Appendix B on “Waiting Periods”.

These amendments take effect on 1 May 2013.

Amendment No 3 of 2013

Amendment No. 3 of 2013 of the Practice Directions contains an amendment to Part IX of the Supreme Court Practice Directions as set out below:

  1. The introduction of a new Paragraph 77A on “Consent judgments or orders involving disposition or transfer of property”.

The amendment takes effect on 1 July 2013.

Amendment No 4 of 2013

Amendment No. 4 of 2013 of the Practice Directions contains an amendment to Part III of the Supreme Court Practice Directions as set out below:

  1. The introduction of a new Paragraph 35A on “Pleadings”.

The amendment takes effect on 15 August 2013.

Amendment No 5 of 2013

Amendment No. 5 of 2013 of the Practice Directions contains an amendment to Part XI and XVI of the Supreme Court Practice Directions as set out below:

  1. Paragraph 83 on “Appeals under Order 55D of the Rules of Court”;
  2. Paragraph 125 on “Form of undertaking”; and
  3. The introduction of a new paragraph 130A on “Applications for appraisement and sale”.

These amendments take effect on 15 October 2013.

Amendment No 6 of 2013

Amendment No. 6 of 2013 of the Practice Directions contains amendments to Parts II, IIIA, XVI and XVIII as well as Appendix A of the Supreme Court Practice Directions as set out below:

  1. Paragraph 8(2) on “Operating Hours of the Supreme Court”;
  2. Paragraph 124(4) on “Arrest of Ships by the Sheriff”;
  3. The introduction of a new Part IIIA on “Alternative Dispute Resolution”;
  4. The introduction of a new paragraph 35B on “Overview of Alternative Dispute Resolution (ADR) for civil cases”;
  5. The introduction of a new paragraph 35C on “ADR Offer and Response to ADR Offer”;
  6. The introduction of a new form 28 on “ADR Offer”;
  7. The introduction of a new form 29 on “Response to ADR Offer”; 
  8. Paragraph 136 on “Electronic Applications for Practising Certificates”; and 
  9. The deletion of paragraph 137 on “Electronic Applications for Practising Certificates”.

These amendments take effect on 2 January 2014.
