Court Fees and Hearing Fees

Court Fees are prescribed in a number of statutory regulations and are payable at various stages in civil proceedings (most of the Court Fees payable can be found in Appendix B of the Rules of Court); usually when documents are filed to or lodged with the Court, upon the sealing of any document and for the provision of copies of documents. In addition, Hearing Fees (based on the duration of hearing) may be payable for matters heard or tried in the High Court or the Court of Appeal.

Apart from Court Fees, for matters before the Court of Appeal, an appellant may be required to provide a security deposit for the respondent’s costs in an appeal.

Hearing Fees (Order 90A of the Rules of Court)

With the exception of certain proceedings listed in Order 90A, rule 3 of the Rules of Court, Hearing Fees are payable for matters heard by the Court of Appeal and before a High Court Judge, and for certain matters heard before a Registrar.

Generally, Hearing Fees are required to be paid when parties are ready for hearing and are usually paid by the plaintiff, the appellant or the applicant, unless otherwise ordered by the Court. Eg, for a trial before a High Court Judge, Hearing Fees are to be paid when the matter is set down for trial by the plaintiff.

Some of the Hearing Fees payable are:

Waiver, Deferment or Refund of Hearing Fees (Order 90A Rule 1(4) of the Rules of Court)

The Registrar may waive, defer or refund of the Hearing Fees upon application or request in accordance with the Rules of Court or the specific provisions under which the action is commenced.

Where a cause or matter has been settled or discontinued, the Hearing Fees shall be refunded if a Request for Refund of Hearing Fees is filed no later than 14 days before the first date fixed for hearing. In other instances, e.g. where the parties did not use up the total number of days allocated for hearing, a Request for Refund of Hearing Fees may be filed to seek the refund of the unused part of the Hearing Fees within one month from the date of the settlement or discontinuance, or the last hearing date.

 

Refund of Filing Fees (Order 91 Rule 3 of the Rules of Court)

Where a document has been filed and it is not used, the filing party may seek a refund by filing a Request for Refund of Filing Fees. A separate Request for Refund of Filing Fees must be filed for each unused document in respect of which a refund is sought.
