Amendments 2021

Amendment No. 1 of 2021

Amendment No. 1 of 2021 of the Practice Directions contains amendments to Part XVI of the Supreme Court Practice Directions. The amendments are summarised below:
 
    1. amendments to paragraph 124 on Arrest of ships.
 
The amendments will take effect on 22 January 2021 and will be reflected at https://epd.supremecourt.gov.sg/ from 22 January 2021.

Amendment No. 2 of 2021

Amendment No. 2 of 2021 of the Practice Directions contains amendments to Part I, Part III, Part IV, Part XII, Part XX and Appendices A and C of the Supreme Court Practice Directions. It also introduces a new Part XXIV of the Supreme Court Practice Directions. The amendments are summarised below:

  1. introduction of new paragraph 1B on References to repealed provisions of written laws;
  2. amendments to paragraph 30 on Originating Summonses;
  3. amendments to paragraph 38 on Summonses to be heard in open Court;
  4. amendments to paragraph 93 on Scope of certain paragraphs;
  5. amendments to paragraph 98 on Taxations involving the Official Assignee, the Official Receiver, the Public Trustee or the Director of Legal Aid;
  6. amendments to paragraph 143 on Bankruptcy applications;
  7. amendments to paragraph 144 on Applications to set aside statutory demands made under the Bankruptcy Rules or the Insolvency, Restructuring and Dissolution (Personal Insolvency) Rules 2020;
  8. amendments to paragraph 145 on Judicial Management and Winding Up applications under the Companies Act or the Insolvency, Restructuring and Dissolution Act 2018;
  9. amendments to paragraph 146 on Documents for use in open Court trials of contested winding-up applications;
  10. introduction of new paragraph 159 on Reference to Actuarial Tables for the Assessment of Damages in Personal Injury and Death Claims;
  11. amendments to Form 11B (Questionnaire for the Examination of (Name of Officer of Judgment Debtor)) under Appendix A; and
  12. amendments to Sample Bills of Costs for non-contentious matters under Appendix C.
 
The amendments will take effect on 1 April 2021 and will be reflected at https://epd.supremecourt.gov.sg/ from 1 April 2021.

Amendment No. 3 of 2021

Amendment No. 3 of 2021 of the Practice Directions contains amendments to Parts I and XI and Appendix A of the Supreme Court Practice Directions. It also introduces a new Part XXV of the Supreme Court Practice Directions. The amendments are summarised below:

  1. amendments to paragraph 5 on Applicability of Practice Directions;
  2. amendments to paragraph 90A on Applications in civil matters before the Court of Appeal and civil matters before the Appellate Division;
  3. introduction of new paragraph 92A on Lapse or cancellation of Grant of Aid under the Legal Aid and Advice Act and the Legal Aid and Advice Regulations;
  4. introduction of new paragraph 160 on Judge Pre-Trial Conference Checklist for criminal cases in the General Division;
  5. amendments to the following Forms under Appendix A:
    • Form 28 (ADR Offer);
    • Form 29 (Response to ADR Offer);
    • Form 31A (Submissions for Application for Leave to Appeal against a Decision of the General Division (Applicant));
    • Form 31B (Submissions for Application for Leave to Appeal against a Decision of the General Division (Respondent));
    • Form 32A (Submissions for Application for Leave to Appeal against a Decision of the Appellate Division (Applicant));
    • Form 32B (Submissions for Application for Leave to Appeal against a Decision of the Appellate Division (Respondent)); and
  6. introduction of new Form 33 (Judge Pre-Trial Conference Checklist for criminal cases in the General Division) under Appendix A.

The amendments will take effect on 30 April 2021 and will be reflected at https://epd.supremecourt.gov.sg/ from 30 April 2021. The amendments set out at sub-paragraphs (2) and (5)(c) to (5)(f) above will apply to applications filed on or after 30 April 2021.

Amendment No. 4 of 2021

Amendment No. 4 of 2021 of the Practice Directions contains amendments to Part II, Part VI, Part XV and Appendices A and D of the Supreme Court Practice Directions. The amendments are summarised below:

  1. amendments to paragraph 29 on Electronic payment of Court fees;
  2. introduction of new paragraph 59A on Swearing and signing of affidavits in Singapore before, and completing of attestation by, commissioner for oaths through live video link or live television link;
  3. amendments to paragraph 61 on Effect of non-compliance;
  4. amendments to paragraph 120 on Use of the Video Conference Facilities and the Mobile Infocomm Technology Facilities;
  5. amendments to paragraph 121 on Applications to use the Video Conference Facilities and Usage of Additional Equipment;
  6. amendments to paragraph 122 on Applications to use the Mobile Infocomm Technology Facilities;
  7. deletion of paragraph 123 on Fees;
  8. amendments to Form 21 (Application to Use the Video Conference Facilities or Mobile Infocomm Technology Facilities (MIT facilities)) under Appendix A; and
  9. deletion of Appendix D (Fees for the Use of Technology Courts and the Mobile Infocomm Technology Facilities).

The amendments will take effect on 2 June 2021 and will be reflected at https://epd.supremecourt.gov.sg/ from 2 June 2021.

Amendment No. 5 of 2021

Amendment No. 5 of 2021 of the Practice Directions contains amendments to Parts II, XI, XII, XV and XXV and Appendices A and G of the Supreme Court Practice Directions. The amendments are summarised below:

  1. introduction of new paragraph 12A on Request for urgent hearing before Judge;
  2. amendments to paragraph 20 on Interpreters and translation;
  3. amendments to paragraph 90 on Skeletal arguments for appeals and matters before the General Division, Appellate Division, Court of Appeal and Court of 3 Judges;
  4. amendments to paragraph 99A on Costs Scheduling;
  5. amendments to paragraph 122 on Applications to use the Mobile Infocomm Technology Facilities;
  6. introduction of new paragraph 161 on Affidavit in support of a Leave Application under section 394H of the Criminal Procedure Code;
  7. introduction of new Form 1A (Request for Urgent Hearing before Judge) under Appendix A;
  8. introduction of new Form 34 (Information Sheet to be exhibited in an Affidavit in support of a Leave Application under section 394H of the Criminal Procedure Code) under Appendix A; and
  9. deletion and substitution of Appendix G (Guidelines for Party-and-Party Costs Awards in the Supreme Court of Singapore).

The amendments will take effect on 2 August 2021 and will be reflected at https://epd.supremecourt.gov.sg/ from 2 August 2021. The amendments set out at above sub-paragraph (9) will apply to all costs orders made on or after 2 August 2021. Appendix G of the Supreme Court Practice Directions as in force immediately before 2 August 2021 will continue to apply to all costs orders made before that date.

Amendment No. 6 of 2021

Amendment No. 6 of 2021 of the Practice Directions contains amendments to Parts IV and VI and Appendix A of the Supreme Court Practice Directions. The amendments are summarised below:

  1. introduction of new paragraph 37B on Summary Table for Applications for Further and Better Particulars, Discovery, Production of Documents or Interrogatories;
  2. amendments to paragraph 56A on Giving of evidence by person outside Singapore though live video or live television link in any proceedings (other than proceedings in a criminal matter); and
  3. introduction of new Form 5 (Form of Summary Table for Applications for Further and Better Particulars, Discovery, Production of Documents or Interrogatories) under Appendix A.
The amendments will take effect on 31 August 2021 and will be reflected at https://epd.supremecourt.gov.sg/ from 31 August 2021.
